Surveyor Advocate
If you are contemplating litigation, we have the in-depth knowledge and experience to help with your claim prior to starting the claim or alongside your legal advisers. We can help look at the merits of your claim and advise on any issue we can potentially foresee.
For example, let us consider a potential claim against a contractor for defective building work. Prior to commencing litigation, which can be costly, we can review the areas in question, undertake a document review and advise on the merits of your case. We can then work alongside your legal advisers to assist and guide on technical matters.
Expert Determination
ED is a low cost, quick, confidential and legally binding alternative to litigation. It does not necessarily require a dispute, it can be used to resolve a technical or cost issue. As Chartered Building Surveyors, we will only take ED instructions on construction related issues, such as cost disputes, defective works or JCT disputes. This is the main advantage of ED, being that the matter is resolved by an individual qualified and experienced in the matter in dispute.
Most of our ED instructions come via mediators when the mediation reaches an impasse. In addition to being confidential and low lost, the matter can potentially be resolved in a matter of weeks, as opposed to months for arbitration or possibly years for litigation.
As ED cases are not reported, the results are confidential which can be beneficial to some parties.
